Independent Contractor Terms

These Independent Contractor Terms ("Terms") govern the relationship between Curb Crews ("Curb Crews," "we," "us") and the individual accepting them ("Contractor," "you"). By checking the box during sign-up, creating an account, or performing any services, you agree to these Terms.

1. Independent Contractor Relationship

You are an independent contractor, not an employee, agent, partner, or joint venturer of Curb Crews. You control the manner and means of performing the services. Nothing here creates an employment relationship. You are not entitled to employee benefits (health insurance, paid leave, workers' compensation, unemployment, retirement, or similar). You are responsible for your own federal, state, and local taxes, and Curb Crews will report your compensation on IRS Form 1099 (or successor) where required. No taxes are withheld on your behalf.

2. The Services

You may accept assignments to move customers' trash, recycling, and related bins from their storage location to the curb before collection, return them afterward, and complete related tasks described in the app. For each assigned stop you agree to:

You are free to accept or decline assignments. Curb Crews does not guarantee any minimum number of assignments, routes, hours, or earnings.

3. Scheduling and Availability

Assignments are tied to customer pickup days. If you accept an assignment, you agree to complete it within the service window. If you cannot complete an accepted assignment, you must notify your neighborhood lead or Curb Crews as soon as possible so coverage can be arranged.

4. Compensation

You are paid on a per-action basis (for example, per bin rolled out and per bin brought in) at the rates set by Curb Crews and shown in the app, which may change on a prospective basis. Pay is calculated from verified, completed service events. Curb Crews may withhold or reverse pay for actions that are incomplete, unverified, duplicated, fraudulent, or not actually performed.

5. Payment Processing

Payments are made through a third-party processor (currently Stripe). You agree to its terms, to provide accurate payout and identity information, and to keep it current. Curb Crews is not responsible for processor delays, holds, or errors outside our control.

6. Performance Standards

You agree to perform services professionally and on time, to place and return bins as instructed, and to provide accurate, on-site photo proof for each stop. Repeated missed stops, false reporting, or poor quality may result in fewer assignments or termination.

7. Photos, Location, and Data Consent

You consent to the app capturing service photos and your device's approximate location and timestamp at the time of service for verification and quality purposes. These photos and records are the property of Curb Crews, are stored privately, and may be used to verify service, resolve disputes, and improve operations. Photos are not saved to your personal photo library by the app.

8. Customer Property and Premises

You agree to respect customers' property and privacy. You will not enter any home or building, will use gate or access codes only as needed to perform the service, will keep such codes confidential, and will report any damage, hazard, or access problem promptly through the app.

9. Conduct

While performing services you will act courteously and lawfully, will not be under the influence of alcohol or unlawful drugs, will not solicit customers for personal business, and will not misrepresent your work or affiliation.

10. Confidentiality

Customer lists, addresses, gate codes, pricing, routes, and other non-public information are confidential. You will use them only to perform services and will not disclose or use them for any other purpose, during or after this relationship.

11. Equipment and Expenses

You provide your own transportation, smartphone, data plan, and any supplies needed, and are responsible for your own expenses unless Curb Crews agrees otherwise in writing.

12. Insurance, Liability, and Indemnification

You are responsible for maintaining any insurance and valid licenses appropriate to your activities (including auto insurance if you drive). To the fullest extent permitted by law, you agree to indemnify and hold Curb Crews harmless from claims arising out of your services, your negligence or misconduct, or your breach of these Terms. To the fullest extent permitted by law, Curb Crews' total liability to you is limited to the unpaid compensation owed to you, and Curb Crews is not liable for indirect, incidental, or consequential damages.

13. Eligibility

You represent that you are legally authorized to work and perform these services and that the information you provide is accurate. Curb Crews may condition assignments on a background check or other verification where permitted by law.

14. Term and Termination

This relationship is at-will and non-exclusive. Either party may end it at any time, with or without cause, by notice (including through the app). On termination, you will stop using Curb Crews systems, return or delete any confidential information, and Curb Crews will pay verified amounts owed through your last service.

15. Intellectual Property

The Curb Crews name, app, software, and operational data are owned by Curb Crews. You receive no ownership or license except the limited right to use the app to perform services.

16. Changes to These Terms

Curb Crews may update these Terms. Material changes will be made available in the app or by other reasonable notice. Continuing to accept assignments after an update means you accept the updated Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. The parties will attempt to resolve disputes in good faith; any unresolved dispute will be handled exclusively in the state or federal courts located in Travis County, Texas.

18. General

If any provision is unenforceable, the rest remains in effect. These Terms are the entire agreement on this subject and supersede prior understandings. Curb Crews' failure to enforce a provision is not a waiver.

19. Acknowledgment

By checking the agreement box or performing services, you confirm that you have read, understood, and agree to these Terms, and that you are entering this relationship as an independent contractor.
